This privacy notice (“Privacy Notice”) describes how Falltech and its affiliates collect and process your personal information through its websites, devices, products, and services. Personal information (“Personal Information” or “Personal Data”) means information that (either in isolation or in combination with other information) enables you to be directly or indirectly identified.

  1. What Personal Information About Consumers Does Falltech Collect?

We collect your personal information to provide and continually improve our products and services.

Here are the types of personal information we collect:

  1. Information we receive directly from you: Types of personal information you provide to us when you contact or engage with us may include:
  • Identity information, which may include your name, title, entity name, contact information, such as e-mail address, telephone and fax numbers, and physical address (including street, city, state, postal code, and/or country);
  • Business information, which may include data related to other employees in your organization, owners, directors, officers, or contractors of a third-party organization (e.g., type of business, company, type of entity, or government agency);
  • Financial information, which may include credit card or other financial account information for the purpose of your purchase of goods and services;
  • Transactional information, which may include the history of your purchases and information required to assist with purchase transactions and the history of your communications with us regarding our products and services;
  • Recruitment information may include information submitted in connection with an employment application or inquiry, such as your education and professional qualifications.
  • Marketing and communications information, which may include marketing preferences and subscriptions to publications; and
  • Feedback information may include recommendations, polls or surveys, or other feedback from you about our Websites, products, and services.
  1. Automatic Information: We automatically collect and store certain types of information when you view and interact with information about our products and content on our websites. Our websites do not contain web store features. However, like many websites, we use "cookies” and other similar technologies, and we obtain certain types of information when your web browser or device accesses our content on our websites, for example:
  • The internet protocol (IP) address used to connect your computer to the internet, your internet service provider;
  • Login, email address, and password;
  • Your browsing activity, usage, and other technical information; and
  • The location of your device or computer.

  1. Information collected from third parties. In accordance with applicable law, FallTech may collect personal information about you from third parties that provide necessary services, for example.
  • Payment receipts and shipping service information and delivery updates
  • FallTech may also obtain your business contact information that your employer or your affiliates may provide to us during a business transaction, which may be used to recommend other products or additional services such as training necessary to use our products.

 

  1. Information From Your Interaction With Us Through Social Media
  • When you use a social network login to access one of our social media pages, you will share certain personal information from your social media account with us. For example, if you connect with us on the LinkedIn page, we will receive and store the information you share with us from that site, including your LinkedIn Profile.

 

  1. For What Purpose Does FallTech Use Your Personal Information?

FallTech may use your personal information, as permitted by law, to operate, provide, develop, and improve the products and services that we offer our customers. For example, these purposes include:

  • Purchase of products and provide customer services. FallTech may use your personal information to fulfill your requests for products and services.
  • Communication with you. FallTech may use your personal information to provide various customer services, including providing you with your purchase history, handling warranty claims, and replacing product manuals.
  • Improving Products and Services. FallTech may use your personal information to improve our products and customer service, troubleshoot and fix errors on the Website, and discover how visitors use the FallTech Website.
  • Marketing. In accordance with applicable laws and regulations, FallTech may use your personal information to provide information regarding products that may be of interest to you and to communicate with you about offers, events, and news.

Opt-out: FallTech allows you to opt-out from marketing communications sent via e-mail by using an “unsubscribe” link in any e-mail marketing materials you receive from us, or by contacting us at dataprivacy@falltech.com.

  • Business Operation. FallTech may, for example, collect and use business contact information to manage contracts, warranties, maintenance, orders, and similar business functions and analyze credit for collection purposes.
  • Recruiting Employees. FallTech may use information in employment applications and resumes to recruit and hire new employees.
  • Comply with legal obligations. FallTech may use personal information to assist with FallTech’s internal compliance and legal requirements and (if necessary) to defend our interests and claims. FallTech may use personal information to prevent and respond to fraud, violations of law, misuse of our Website, and violation of intellectual property infringement.
  1. Disclosure of Information To Third Parties

While FallTech does not sell Personal Information in exchange for any monetary consideration, we do share Personal Information for other benefits as defined by Cal. Civ. Code §1798.140 (ad)(1) and (2). In the preceding 12 months, we have shared Personal Information as necessary for specific “business purposes,” as defined by Cal. Civ. Code §1798.140(e) and specified in the section “How do we share and disclose Personal Information to third parties?” This includes sharing personal identifiers, commercial information, internet or other electronic network activity with payment processing providers, customer relationship management, consulting, e-mail, product feedback, helpdesk services, advertising networks, and website analytics companies.

  1. How Do We Share And Disclose Personal Information To Third Parties?

FallTech may share your personal information with trusted third parties such as service providers, vendors, and consultants in accordance with the applicable law. FallTech requires that these third-party service providers access your personal information only when necessary and to comply with our privacy policy to protect the confidentiality of your personal information.

  • In connection with transactions. In connection with certain transactions, FallTech may disclose some or all of your personal information to financial institutions, government entities, shipping companies, or postal services involved in the fulfillment of the transaction.
  • Service Providers. FallTech may share your personal information with vendors and consultants contracted to provide services on our behalf, such as hosting websites, processing purchase transactions, and providing support services for network security and operations.
  • Distributors. FallTech may share your Personal Information with third parties authorized to distribute our products.
  • Marketing. FallTech may share your personal information with trusted third parties to improve its websites and assist with marketing matters.
  • Transfer of Business. Circumstances may arise where FallTech decides to sell, buy, divest, merge, or otherwise reorganize businesses in some countries for strategic or other business reasons. FallTech may disclose the information we maintain about you to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition, divestiture, or sale of all or a portion of the Company’s assets.
  • Other Reasons. FallTech may disclose personal information if required or authorized to do so by law or in the good-faith belief that such action is necessary to comply with legal requirements or with legal process served on us, to protect and defend our rights or property or, in exigent circumstances, to protect the personal safety of any individual.

If you facilitate a transaction with FallTech, request information, a product, or services from FallTech, or otherwise engage with us, such activities require FallTech to share your personal information with a service provider or third party. In that case, you hereby direct FallTech to intentionally disclose your personal information to the service provider or third party as described herein, provided the third-party service provider access only the necessary information it requires to perform its services and to comply with our privacy policy to protect the confidentiality of your personal information.

  1. Security

We use appropriate technical, organizational, and administrative security measures to protect any Personal Information we store from loss, misuse, unauthorized access, disclosure, alteration, and destruction.

You must protect against unauthorized access to your password and your computers, devices, and applications. We recommend using multifactor or two-factor authentication when available, or a unique and strong password for FallTech website(s) (that requires a login) not used for other online accounts. Be sure to sign off when finished using a shared computer.

  1. Anonymization of information

In accordance with applicable law, FallTech may anonymize your personal information so that it can no longer be used to identify you. Anonymized information is not considered personal and, therefore, not subject to this Privacy Statement. FallTech may collect, use, aggregate, and share anonymized information for any purpose.

  1. Do Not Track

Some web browsers may transmit “do-not-track” signals to the website. Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend these signals to be transmitted or even aware of them. FallTech currently does not take action in response to these signals.

  1. Children's information

Our website content is not directed to, and should not be used by, children or minors under thirteen (13). We do not knowingly collect or solicit Personal Information from anyone under the age of 13. If you are under 13, please do not attempt to register for the services or send us any Personal Information about yourself. If we learn that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible. If you believe a child under 13 may have provided us with their Personal Information, please contact us at dataprivacy@falltech.com.

We may transfer the data we collect about you to countries other than the country where we originally collected it for the purpose of performing

Those countries may not have the same data protection laws as your country. However, when we transfer your data to other countries, we will protect that data as described in this Privacy Notice and take steps, where necessary, to ensure that international transfers comply with applicable laws.

You are permitted, and hereby agree, to only disclose or otherwise provide any and all personal information (including personal information about yourself or a third party) to FallTech if such personal information is accurate, reliable, and relevant to our relationship and only to the extent such disclosure or provision will not violate any applicable data protection law, statute, or regulation, or infringe upon any person’s data privacy rights or privileges.

You may have certain rights relating to your Personal Information, depending on your location and subject to local applicable laws. These rights may include, subject to any exceptions or limitations:

The right to know what Personal Information is being collected and for what purpose.

The right to know what Personal Information is being “sold” or “shared,” for what purpose, and the categories of recipients of your Personal Information.

The right to access your Personal Information.

The right to have your Personal Information rectified, corrected, or updated.

The right to have your Personal Information deleted, including from any third parties where your Personal Information has been sold, shared, or disclosed.

The right to opt out of the “sale” or “sharing” of your Personal Information.

The right to object to the processing of your Personal Information.

The right not to be subject to any automated decision-making and profiling.

  1. European Residents’ Privacy Rights:

Currently, FallTech does not sell any products or services in European territories (“European Territories"), which means the European Economic Area, Switzerland, and the United Kingdom. FallTech sells its products wholesale only through authorized distributors. It has no product distributors in European Territories. We do not knowingly collect or solicit Personal Information from residents of European Territories. If you are a resident of European Territories, please do not send any Personal Information.

If you are a European resident who chooses to interact with our content on our Website, the Personal Information automatically collected may be through cookies operating on the website. We will generally process personal data about you based on consent. For example, when you visit our website, you will be asked to consent to Falltech's use of cookies. You can change your consent or withdraw your consent using our Cookie Preferences tool at the bottom of this website through the “Opt-Out of Cookies” page.

As mentioned above, you can access, correct, update, or request deletion of your personal data through the “Data Request” page on the Opt-Out of Cookies page. You can also contact our data privacy officer by email at dataprivacy@falltech.com.

Furthermore, you have the right to complain to a data protection authority about our collection and use of your personal data.   1. NEVADA PRIVACY RIGHTS

Nevada law (SB 220) permits customers in Nevada to opt-out of the sale of personal information. A sale under Nevada law is the transfer of this personal information to third parties for monetary consideration. Since FallTech does not sell your personal information to third parties as defined in SB220. Therefore, if you are a Nevada resident, opt-out of the sale of personal information does not apply to the personal information you would provide to FallTech. However, if you have questions or concerns, please contact our Data Privacy Officer at dataprivacy@falltech.com.

Our website may contain links to third-party websites, products, and services. FallTech has no liability or responsibility for those websites, products, services, policies, or the collection or other processing of your personal information. The practices of those third parties concerning information collected through their websites, products, or services are governed by their own privacy policies. ADDITIONAL STATE-SPECIFIC PRIVACY DISCLOSURES

This Privacy Notice provides additional state-specific privacy disclosures (“Disclosures”) which describe the Personal Information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. These disclosures are required by the California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act and serve as a Notice at Collection under the California Privacy Rights Act and other U.S. States as new laws are enacted to protected consumer privacy.

  1. Categories of Personal Information Collected: The Personal Information that FallTech collects, or has collected from consumers in the twelve months before the effective date of this Privacy Notice, falls into the following categories established by the California Privacy Rights Act:

  • Inference Data drawn from any of the above categories of Personal Information.

PLEASE NOTE: FallTech does not collect or use any sensitive categories of Personal Information.

  1. Categories of personal information disclosed for a business purpose: The Personal Information that FallTech disclosed to the third parties identified in the section entitled “for what purpose does FallTech use your Personal Information?” Personal Information disclosed about a consumer for a business purpose in the twelve months before the effective date of this Disclosure falls into the following categories established by the California Privacy Rights Act.
  • Personal Identifiers such as your name, user name, address, phone numbers, your FallTech account log-in information;
  • Personal Information, Namely, Payment Information, such as a credit card number or other payment information, for example, if we use a third-party payment processor;
  • Commercial Information, such as the details of a product you purchased if a third-party service provider is providing shipping and handling services;
  • Internet Or Other Electronic Network Activity Information if we use a service provider to help provide network support and security and analyze the health of our network system and devices;
  • Geolocation Data, which may constitute precise geolocation data, such as providing a shipping service provider with your location to deliver FallTech products to you; and
  • Inference Data, for example, if we use a service provider to help us optimize the curacy of your shipping address to ensure your order reaches you.

As explained in the section “How Can I Exercise My Privacy Rights?” you may have certain data rights under state privacy laws to request information about the collection of your Personal Information by FallTech, to access your Personal Information, to correct or delete your Personal Information, you may also have the rights under the Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act, or the sharing of your personal information for cross-context behavioral advertising, as defined by the California Privacy Rights Act.

FallTech provides information about its products on its website. FallTech is not a retailer, and its websites do not contain an online store feature. Nevertheless, you may submit a Data Request form to access, correct, or delete your Personal Information FallTech may have, if any.

We endeavor to respond to a Data Request within the required timeframes. We will inform you of the reason and extension period in writing if we need more time. If you submit your Data Request electronically through our request form, we will deliver our written response to the verified email associated with the request. If you have emailed your request to dataprivacy@falltech.com, we will respond to the email address used to submit the request. If you would like to mail a hard copy of the Request to the Data Privacy Officer, let us know the email or mailing address to send our response. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

  • Right to Appeal – California and Colorado: If FallTech does not take action on your Privacy Rights Request within the 45-day response period, or in the event of an extension, within the maximum 90-day response period, we will inform you in writing of the reasons for not taking action, as well as provide an explanation of any rights you have to appeal the decision.
  • Right to Appeal – Virginia and Connecticut: You have the right to appeal a refusal to take action on a Privacy Rights Request within a reasonable period after your receipt of our decision. Within 60 days of receipt of an appeal, FallTech will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If the appeal is denied, you will be provided with a method through which you may contact the Attorney General of Virginia if you are a Virginia resident or the Attorney General of Connecticut if you are a Connecticut resident to submit a complaint.
  1. No sale of personal information: In the twelve months prior to the effective date of this Disclosure, FallTech has not sold any personal information of consumers, as those terms are defined under the California Privacy Rights Act.

 

  1. California Privacy Rights Act Sensitive Personal Information Disclosure. The categories of data that FallTechcollects and discloses for a business purpose do NOT include "sensitive personal information" as defined under the California Privacy Rights Act.

 

 

  1. California Privacy Rights Act Rention Disclosure

The period during which we retain your personal information varies depending on the purpose of processing the information.

We store your Personal Information for different time periods depending on the category of Personal Information and the nature of the relationship that you have with us. We determine how long we need Personal Information on a case-by-case basis. Still, our goal is to keep your Personal Information for as short a period as possible to achieve the purpose for which Personal Information is collected. We consider the following criteria to determine how long we will retain your Personal Information:

  1. Whether the Personal Information is necessary to operate or provide our services.

            For example, account information may be retained for a longer period of time based on the Agreement you have with us.

            Additionally, we may store personal information required to provide you with FallTech products and product use training services or to assist with requested transactions if you are an ongoing distributor or a customer of FallTech products.

            If you provide us with an employment application or your resume, FallTech will retain details of your application as set forth in this Privacy Notice or other notice made available to you in connection with your employment application.

  1. The length of time we need to retain the Personal Information to comply with our legal obligations

            Our legitimate interests or legal purposes include network improvement, fraud prevention, record-keeping, promoting safety, security, and integrity, and enforcing our legal rights.

  1. Whether the Personal Information, which has been collected as a part of a marketing event, is typically deleted based on specific event schedules.

            FallTech may store your personal information for marketing reasons unless you have opted out of receiving further direct marketing communications in accordance with applicable law.

            In all other cases, FallTech may retain your personal information as long as it is needed to fulfill the purposes outlined in this Privacy Notice, after which it is either deleted or destroyed.

  1. California Privacy Rights Act Non-discrimination Statement. FallTech will not discriminate against any consumer for exercising their rights under the California Privacy Rights Act.

 

  1. California Privacy Rights Act, Colorado Privacy Act, Connecticut Data Privacy Act, Utah Consumer Privacy Act, and Virginia Consumer Data Protection Act De-identified Data Disclosure. FallTech may use de-identified data in some instances. FallTech either maintains such data without attempting to re-identify it or treats such data as personal data subject to applicable law.

 

  1. Colorado Privacy Act Profiling Disclosure. FallTech does not engage in the profiling of consumers in furtherance of automated decisions that produce legal or similarly significant effects, as those terms are defined under the Colorado Privacy Act.

Changes to this Privacy Notice

FallTech may periodically update this Privacy Notice. When the Privacy Notice is updated, we will revise the "last updated" date at the top and bottom of the Privacy Notice and take such additional steps as may be required by law.
